Are You Behind On Rent Due to Covid-19? (Updated)

*This post originally contained advice from Legal Aid Society of San Mateo County for people who might be impacted by the 8/31 expiration of San Mateo County’s Eviction Moratorium. Since it was posted there have been some recent developments (see below). Please see Legal Aid’s website for further updates and resources.

Update 9/1/2020 at 8:30pm: Tonight the C.D.C. issued an order temporarily halting evictions through December 31. It applies to tenants who expect to earn less than 99,000 this year and who meet other criteria. The order does not relieve tenants of their obligation to pay rent. Forms to apply will be available on the C.D.C. website once the order is published in the Federal Register on 9/4/2020.

Update 9/1/2020 at 11:00am: Last night Governor Newsom signed AB 3088 into law which extends the moratorium. From the press release: “Under the legislation, no tenant can be evicted before February 1, 2021 as a result of rent owed due to a COVID-19 related hardship accrued between March 4 – August 31, 2020, if the tenant provides a declaration of hardship according to the legislation’s timelines. For a COVID-19 related hardship that accrues between September 1, 2020 – January 31, 2021, tenants must also pay at least 25 percent of the rent due to avoid eviction.” (See also: “Newsom signs California eviction moratorium for renters hurt by pandemic,” 8/31/2020).
